New book on prenup mediation

Attorney Laurie Israel has practiced law for 30 years. She started as a tax lawyer, then went into general practice and concentrated on family law and estate planning. About 10 years ago, she published an online article entitled "Ten Things I Hate About Prenuptial Agreements." The piece went viral on the internet because an attorney hadn't written an article like that before.

Israel has recently wrote an article for mediation.com discussing her new book entitled The Generous Prenup: How to Support Your Marriage and Avoid the Pitfalls. The previous article made her popular with couples who wanted a prenup, which in turn meant that Israel did a lot of prenups in the last 10 years, particularly as a mediator. This led to this informative new book.

Writing A Better Prenup

Israel discusses the drawbacks of prenups and how mediation can make both parties happy. One example of this thinking is as follows:

Drawbacks of a prenup: The very nature of a prenup indicates that one side has some amount of wealth that they are unwilling to share. Or, the only time there is sharing is if the more moneyed spouse wishes to do so.

Solution: Change that separate property into marital property immediately or over time.

Rationale: Marriage is a joint venture whose health and success is based on the active and equal participation by both sides. This includes the financial side of the marriage.

An attorney who can constructively mediate various parts of a prenup, postnup, divorce or other family law matter can be a tremendous asset in finding satisfactory solutions to legal, financial or familial disputes. If done right, the couple will be satisfied and thereby more easily move on to the next phase of their lives, ideally one that includes a marriage with a generous prenup.
