What Is A No-Fault Divorce?

New York has recently passed a new law that allows couples to divorce without alleging fault. Under the old law, a divorce could only be granted on certain grounds such as adultery, abandonment, imprisonment or cruel and inhuman treatment. As of October 2010, the New York Legislature passed bill no. 113-19, which allows two people to dissolve a marriage for any reason by citing an irretrievable breakdown of the marriage for six months or more.

A no-fault basis for granting divorce will likely make the process less adverse and more humane. It won’t, however, make it any easier. Divorce is a difficult and emotional time in your life. If you and your partner don’t agree on all aspects of your divorce, your divorce is contested, and the following issues may have to be litigated in court:
