KEITH SCHULEFAND: I try to put myself in the shoes of the other lawyer and the other party and because I think it's important in trying to reach a resolution, one, from a negotiation perspective. You're trying to understand what's most valuable to the other side because when you understand that, then you know what you can get back on your side. If you understand what's most valuable to them, you can figure out what type of concessions you can receive from the other side.

So I always try to put myself--and not just in the other party's shoes. When I--and I often speak to my clients about this. And I do it I would say in 95% of the meetings. I always talk about--I always try to put myself also in the position of the judge or the person who's going to make the decision. And I try to think about and I try to advise my clients based on listening to both sides what's a judge because if we can't reach an agreement, it's going to go to a judge, who's in theory a neutral party, who's going to make a decision based on what he or she hears.

And so I try to put myself in that role as well. And I try to mold my advice both in thinking about what my client wants, what I think the other side might value, and what I think a court might do if we can't reach an agreement.
