How Much Will My Divorce Cost?

This is a difficult question to answer, because so many factors contribute to the cost of a divorce. In general, a litigated divorce will cost more than a divorce that can be settled amicably. In a divorce, it pays to be flexible and to keep your focus on your true priorities. My philosophy is that there are no winners and losers in divorce; the goal is to find a solution that allows both parties to move forward.

Will My Cheating Spouse Have To Pay The Costs Of The Divorce?

No. That is not how it works. While adultery can be cited as grounds for divorce, fault is not used to determine who bears the financial burden of the divorce. Besides, most cases now are no-fault divorces.

How Will Custody Of My Children Be Decided?

The overriding factor in a child custody is “the best interest of the child.” In most cases, this is joint legal and physical custody. It is rare in today’s age of shared parenting to receive sole custody.

My Spouse Makes More/Less Than I Do. Will I Receive/Pay Spousal Support?

Spousal maintenance is not about making each party’s finances 50-50; it is about making sure one spouse does not fall into poverty or have a significant decrease in quality of life. Spousal maintenance depends on many factors, including the length of the marriage and the ability of each spouse to provide for his or her own needs.

How Is Property Division Decided?

All marital assets are subject to equitable distribution during divorce in New York. Equitable distribution does not necessarily mean a 50-50 split. Not all assets can be split in half (real estate), while others are not subject to property division (inheritance). The goal is to make sure that each side maintains property that equals the same value or as close as possible. This also applies to marital debts.
