It is a common misconception that a couple is automatically divorced after living apart for one year. This is only true if a formal separation agreement is in place and a conversion divorce is sought. In general, we do not recommend this approach; our philosophy is to just get the divorce done with and not drag out a potentially painful process.

No-Fault Divorce

As of 2010, the days of needing to cite adultery, abandonment, imprisonment, or cruel and inhuman treatment as grounds for divorce ended. No-fault, more commonly known as "irretrievable breakdown of the marriage" can now be cited as the grounds for divorce. In order to obtain a no-fault divorce, a couple must have all of their other issues agreed upon, including child custody, child support, spousal maintenance and division of property.
